Research On Hazards And Suggestions Of “Trial By Network”

China is in a transition period now, all kinds of social contradictions are prominent increasingly.In the era of web2.0, Netmedia tend to play a bigger role in monitoring the social hot issues.On the one hand,Netmedia make contribution to soluting the social problem fairly and speedly;On the other hand, however, it also make "trial by media " present as a normal tendency.“Trial by network” describe a phenomenon that the mass media and the netizens do judgement to the crimes before court verdict.This behaviour will not only affect the party's physical and psychological health,but also the establishment of judicial authority and judicial fairness.In order to analyze the report form and content of “Mr Li ” case, this article will take the Tencent.com as an example.And for the purpose of comprehensive analysis and study,the paper will also take same related case into account. The purpose of this article is to reveal the new characteristics and perniciousness of “trial by netwok”,then explore the causes of “trial by netwok” from following three aspects:justice,network media and netizens discusses.On the basis of analysis,the paper put forward four countermeasures:First, Consummate the related laws and institutions,make sure that the supervision can act in accordance with the loww; Second, Take the advantages of technology thoroughly,gurantee the news media can grasp the public opinion timely;Third,The traditional and new media should be combined together to build a linked mechanism;Fourth,educational activities should be carried out to improve the netizens' media literacy,encrouge the netizens to speak rationally.Through these tactics the media supervision and citizen right should be fully guaranteed, at the same time, the judicial independent and fair can be protected.This paper consists of six parts: the first part elaborates the research background,significance, methods etc., and review the related literature and theory;The second part take the "Mr Li" case as an example, analysis the data of Tecent.com's report form and the contents;The third part elaborates on the features of network media trial, harm and caus accordto the result of data analysis;The fourth part anwser the question that how to deal with "Trial by network";The fifth part of the paper is analyze the deficiency in this study,and make prospect for the future research.
