Research On The Legal System Of Rural Social Endowment Insurance In China

The rural social endowment insurance legal system is the guarantee system to solve the problems of rural social pension,is a basic human rights system to protect farmers’ rights to survival and development.Because the level of economic development gap between the rural areas large,local regulatory regions has the difference,plus the rural social endowment insurance legal system construction started late,time is short,therefore,the system of China’s rural social endowment insurance law at the present stage exposed many problems,such as the rural social endowment insurance,lack of laws and regulations,lower the level of protection and the fund operation mode should be improved,the government responsibility is not in place.These problems are great obstacles in process of construction of the rural social pension insurance legal system.In 2009,the trial operation of the new rural insurance system,the introduction of social insurance law in 2010,and the introduction of the 2014 urban and rural integrated endowment insurance guidelines have greatly enriched the legal system of rural social endowment insurance in China.From this we can see that the legal system of rural social endowment insurance has made great progress in China.However,because there are still imperfect legal system,rural economic development around the uneven problem of legal supervision mechanism is not perfect,some of the rural social endowment insurance legal system is inadequate in the implementation process.In order to ensure the goal of building a well-off society in an all-round way in 2020,it is the most important and urgent task to formulate and improve the legal system of rural social endowment insuranceIn this paper,persist in our country and the actual situation of the rural areas,farmers,and combined with the law of professional theory and knowledge,introduces the development process of the system of China’s rural social endowment insurance law,discuss the existed system of our country rural social endowment insurance legal problems,and carries on the thorough analysis.At the same time,this paper draws on the experience of foreign developed countries in the rural social endowment insurance legal system,puts forward some feasible suggestions on improving the system of China’s rural social endowment insurance law.These suggestions are: should the existing rural social endowment insurance law,regulations for the integration of science,strengthen the construction of endowment insurance law of integration of urban and rural residents;the government should increase the rural social endowment insurance financial subsidies and actively fulfill their supervisory duties,earnestly implement the responsibility of the government;the old-age insurance fund management should adopt multi-level the management mode,both centralized and unified management and play local advantage;To distinguish the legal relation of rural social endowment insurance,so as to perfect the settlement mechanism of rural social endowment insurance dispute in China.
