The Confucian classics,"book of Rites" records:"the road trip,the whole world as one community and those of other countries.The enemy came close to its close.not only son,so that providing for the elderly,have to use strong,the young director,single,widowed,orphaned and alone,disabled people who have no support".This poem is for having heard it many times in China is the earliest record of social security and pension thought is discussed,that the ancients is full of wisdom and look forward to the construction of the pension system.Since ancient times.China has always attached great importance to people's livelihood and welfare.The party's eighteen clear requirements:Party committees and governments at all levels should continue to strengthen social construction,efforts to protect and improve people's livelihood,and constantly innovate social management,so as to ensure social harmony and stability.To protect and improve people's livelihood is a very important basic project,in this process,we should fully understand the sufferings of the masses and needs,solve practical problems concerned with the broad masses of the people and the most direct,let the people enjoy the fruits of reform and development.A sense of home and the best of each person,but also an important manifestation of the government responsibility and social responsibility.On the whole,China is a large agricultural country,the overall number of farmers.Since the reform and opening up,especially in recent years,with the development of city,a lot of rural labor in order to obtain better employment opportunities have come to work in the city,stay for the elderly and children is increasing,which makes the function of the land endowment is greatly reduced.In addition,with the increasing number of elderly people in rural areas,rural old-age care has become an urgent need to solve the practical problems.Due to historical and realistic factors,the social endowment insurance system in our country and did not cover the majority of farmers,which not only caused the uneven development of urban and rural areas,can not fully reflect the reform and opening-up of our country benefit farmers.Therefore,the author believes that China should establish a sound legal system of rural social endowment insurance,the promulgation of more relevant laws and regulations,and on the basis of the recommendations to improve the relevant legal system.This paper is divided into four parts:In the first part,the author focuses on the definition and characteristics of endowment insurance are discussed,on China's rural endowment insurance system are introduced.The related theory of endowment insurance system from politics,economics and law angle is discussed,and its purpose is to have an overall understanding of China's rural endowment insurance system.In the second part of the legal system of rural endowment insurance is introduced,reveals the legal system in the process of legislation and law enforcement problems,detailed and analyzed the causes of these problems from multiple perspectives.In the third part of the paper,the author introduces the foreign representative system of the rural old-age insurance system in foreign countries,and summarizes the advanced experience and practice of foreign countries with the actual situation of our country in the three part.In the fourth part,the author discusses how to improve our legal system of rural endowment insurance,not only from the angle of legislation and law enforcement are analyzed in detail,and also from the sound system and put forward some suggestions and measures are very constructive to improve the rural endowment insurance law system.
