| Universities and colleges' Supervising power to students is the power that organizes and coordinates enrolling system, registering management, attendance and regulation, awards and punishment, employment guidence etc. Under the current law system, universities and colleges utilise legislative power to supervise students, and thus is a kind of administrative power. The contents of this power consist of abstract administrative power and concrete administrative one. The right of students in universities and colleges are those rights that result from their identification as students and citizens and during the course of education in universities and colleges. Their rights include entity right and procedure right.These years, administration in universities and colleges in our country develop rapidly and stably, and the protection of students' right in universities and colleges have been consummated year by year. However, we should notice that some defects still exist at the same time, such as we need to pay more attention to the management of university and colleage students, the laws regarding administrating universities and colleges conflict with each other. As a result, rights of students' education, right of privacy, right of property and some other rights have been seriously damaged.The conflicts between administration of university and college students and rights of students include two kinds: one is the conflict between administration in universities and colleges and rights of students in universities and colleges result from the students as citizens: the other is their identity as students. The causes of these two kinds of conflicts resulted from the influence of traditional ideas, wrong recognition of the nature of administration, legislative deficiency of administration of universities and colleges, imperfect of procedures and rules, lack of relieving right of universities and colleges' rights etc.To resolve the problem, laws go first principle, laws reservation principle, porpotion principle, proper procedure principle, and rationalization principle must be applied and concrete management of universities and colleges, abstract management of universities and colleges, right relieving systems should be set up. |
