China University Management Students' Rights Protection Mechanism Study

The college should be well aware of the contents of student rights and the necessity of student rights protection to build a harmonious campus. The college should also pay close attention to the possible problems relating to the student rights and actively promote the construction of student rights protection mechanism. College student rights which can be divided into substantive rights and procedural rights are the legal rights and interests admitted and guaranteed by the existing laws. Student rights protection mechanism can be identified as an organic whole which ensures the student rights. The mechanism classifies the factors in relation to student rights and then follows proper rules to fully stimulate the initiative of all quarters to maximize the rights of students.Student rights protection, which is the extension of rights protection, is becoming a popular topic. The reason is that the protection of student rights has profound origins and basis not only in philosophy, but also in education, sociology and law. In recent years, theorists offer effective guide for student rights protection. The colleges also try new measures to protect the student rights. However, owing to the impacts of traditional management, the innovation of management does not keep pace with the times. On the other hand, the students'rights protection consciousness is in a very low level and thus leads to the trespass of substantive rights. For the above reasons, it is necessary to construct the student rights protection mechanism in college management.The construction of student rights protection mechanism is not only the necessity of solving the student rights problems, but also the specific requirements of constructing people-oriented and harmonious campus. In the process of constructing the mechanism, we should stimulate the initiative of all quarters to deal with the issues beforehand and afterwards. The constituents of the system involve two elements:the subject and the security. The subject is the direct participant of student rights protection mechanism:college, education administrator and students. Security can be divided into four parts:mechanistic assurance, institutional assurance, procedural assurance and practical assurance. Rights protection (a system which prevents the rights from being invaded), rights relief (a remedy of the operation of the mechanism) and feedbacks (applied throughout the process of the operation of the mechanism) are the contents of the mechanism operation. The operation of student rights mechanism in college management has its intrinsic requirements. To be specific, it should be in agreement with the spirit of legality and should meet the demands of some principles.The operation of student rights mechanism can't do without the macro-control of the college, the counseling of the administrators and the coordination of the students. Now, only by pulling together can we guarantee the effective operation of the mechanism to protect the legal rights of the students. College, which is the constructor of the student rights protection mechanism, is responsible for the macro-adjustment of the mechanism. The college should not only pay special attention to the mechanism and create the environment which guarantees the rights, but also should carry out pluralistic measures. As the promoter of the student rights mechanism, the education administrators should insist on participating in the trainings and counseling. As regards the college students, they should obey the management of the college and coordinate with the administrators to improve the abilities of rights protection, and finally maximize their legal rights.
