| The Hui is a nation of Islam.In the long years,the Islamic culture has shaped the Hui people’s character,and in the process of localization evolved into Hui customary law.Helan County,located in the Ningxia Hui Autonomous Region,is the town with Islamic style and modern atmosphere.A special group called "imam" lives on this land.They have profound religious knowledge and religious attainments.So they enjoy a high authority among the Hui people.By virtue of this religious identity and religious authority,imam mediates the contradictions and disputes between the Hui people and maintains the harmony and tranquility of the Hui community.Imam mediating civil disputes(Hereinafter referred to as "imam mediation")has many advantages,such as low cost,high efficiency,so it is widely used.But the operation and development of the imam mediation is not smooth.Therefore,it is of great significance to understand the plight of the imam mediation and its causes,and to put forward the concrete and feasible suggestions to play the active role of the imam mediation.This article takes Helan County as the field point,by the method of anthropology research,supplemented by the research route of other disciplines to carry on the related research to the imam mediation.Hoping to stand on the shoulders of the giant,I can explain the general principle of the imam mediation,discuss the practical problems of the imam mediation,and give rationalization proposals for promoting the harmony,stability and legal system of the ethnic areas.The full text consists of the following five parts:The introduction part mainly introduces the research background,purpose and significance of the paper,the research status,the related description,the definition of the concept of imam mediation,the research methods and ideas of the paper,and the field work.The first chapter is an overview of the field,I will outline the social scene of the field through introduction of Helan County’s human geography,civil disputes and legal culture.The second chapter is about the imam mediation related to general principle,including historical origin,realistic characteristics,theoretical basis.Pointed out that the imam mediation is a cultural heritage,ancient has been.Describe the three characteristics of imam mediation: nationality,religious,authoritative.Analysis of the theoretical basis of the imam mediation,indicating the imam mediation has the legitimacy and necessity.The third chapter is the case analysis of the imam mediation,through the typical case showing the style of imam mediation,summing up the basic procedures of the imam mediation,finding the imam mediation in the operation of the changes and difficulties,and then analyzing the imam mediation difficulties encountered reasons.The fourth chapter is about the thinking of the improvement of the imam mediation,including the principles to be followed and the specific path two levels of discussion.I will put forward the feasibility suggestions from the official,imam and the interaction between the two to improve the imam mediation. |
