Research On The Legal Guarantee Of The Development Of Sports Events Industry In China

As the core of the sports industry, the proportion of sports events industry is not large. Sports events industry need more labor, material resources and money, along with the increasing diversities, The sound laws and policies can promote the standardized development of sports events industry, therefore, it is necessary to study the legal protection of the sports events industry development. In this paper, methods of literature, comparative analysis expert interviews and case analysis are used to study the legal guarantee of sports events industry's development, drawing the following conclusions:1. The sports events industry is more obvious in classification, and it's features is distinctive. Obviously, the effect is significant on domestic economy:(1) Promoting sports consumption, expanding domestic demand and stimulating economic growth.(2) Attracting more investment from the enterprises.(3) Creating more employment opportunities.2. The nature, the subject, the object, and the right of the sports events broadcast have no clear legal provisions. The infringements on the logos of Sports events are various forms.3. The right of the Olympic Games broadcast and logos is more perfect in legislation, law enforcement and judicature. Moreover, in the aspect of legislation, There is no special legislation on the broadcasting rights of sports events. Although there are many laws of sports events logos, it's lawless and not becoming a legislative system. In addition, the logos are protected by the national multiple laws. In the law enforcement aspects, the departments of China's administrative gradually strengthened fight against the infringement problems of sports events broadcast and logos. However, the necessary communication and coordination between the various departments is lacking. In the specific enforcement process, the law enforcement standards can't be unified, and law enforcement is controversial. In the judicial aspect, the judicial trial period in cases of infringement is longer between sports events broadcast and logos, and the efficiency is not high.4. Many serious legal problems exist in the development of China's sports events industry. The main issues are:(1) the sports events laws is single with lower legislative level and lack of systematic completeness;(2) Legal accountability system is not perfect;(3) legal protection of investment and financing mechanism is not perfect yet;(4) There is a lack of self-discipline mechanism and awareness of certain rights protection;(5) Law enforcement is not enough with absence of certain incentive mechanism;(6) Legal publicity is not in place.5. Experience of foreign sports events industry:(a)U.S.A(1) The copyright protection of network broadcasting rights is provided by Copyright Law.(2) The introduced Sports Broadcasting Act and Sports Broadcasting Law provide legal basis for the formulation of sports broadcasting law in our country.(3) SOPA and PIA draft urge China's sports industry related laws and regulations should be formulated as soon as possible.(4) Legal relations between the US federal and local governments is more convincing in the respect of the macro-controls on events industry.(b) Australia: Copyright Law Amendment(Digital agenda)(2000) provides legal protection for the sports event network broadcast in the background of digital network age.(c) South Korea: South Korea Sports Industry Revitalization Act is formulated by the national government department with higher legislation level, which can provide the reference for the legislation of the sports industry relevant laws and the improvement of legislative level in our country.6. According to the various legal problems of sports industry, the legal measures to develop sports events industry mainly include:(1) Improve the relevant legal system and the legislative level and establish a set of sound legal system;(2) Law enforcement should be carried out quickly and effectively;(3) Formulate relevant laws and regulations policy for investment and financing;(4) Establish industry self regulatory mechanism and improve the protection awareness of sports event industry;(5) Intensify the crackdown on Infringement and establish a set of sound incentive system;(6) Strengthen the publicity of sports events industry laws.
