Teachers' disciplinary punishment is one of the professional rights to manage their students.However,teachers in primary and secondary school encountered a lot of confusion during exercising the disciplinary right and had to be faced a lot of problems,due to the lack of legislative basis and ambiguous understanding from other people.Legal disputes became apparent concerning disciplinary punishment.So,what is the primary and secondary school teachers' discipline right? How to exercise disciplinary right? How to protect the teacher's disciplinary right? These have become a major problem for primary and secondary school teachers in the practice of managing students.This study takes the primary and secondary school teachers' disciplinary phenomenon as the breakthrough point,and explores the historical roots of the disciplinary right by analyzing the history of the teacher's disciplinary right.And then the current situation of the teacher's disciplinary right in primary and secondary schools is investigated.Analysis of the problems in the exercise of the right to discipline of teachers in primary and secondary schools showed that the main problems are: Teachers have no law to rely on and the random nature of discipline is large;the school accommodates students and their parents,teachers are facing excessive pressures;Parents do not understand it and Public opinion does not support teachers,Analysis from the legislative factors,social factors,school factors,family factors and other influencing factors on these issues is given.Finally,suggestions on the existing issues,on the implementation and protection of the disciplinary right of teachers in primary and secondary schools,are presented.
