The Study On China's Contermeasures Of Deliberative Democracy Development Under The Perspective Of Constitution-based Goverance

It marks a new stage in the rule of law for the 18 th CPC National Congress.To build the society ruled by law is as the underlying philosophy of the social development in China,it plays an important guiding role and important references for the social construction and development.With the development of the rule of law society in China,consultative democracy and related system construction are directly related to the construction of the rule of law society.The Fourth Plenary Session of the 18 th CPC Central Committee clearly puts forward: to strengthen the construction of socialist deliberative democracy system,promote the development of deliberative democracy to be widely multilayer institutionalization,build reasonable program,complete system of deliberative democracy.We will improve and develop community-level democratic systems,promote grassroots democracy and industry self-discipline in accordance with the law,and implement self-management,self-service,self-monitoring,and self-supervision.By the fourth plenary session of the 18 for the clear of idea and concept,further pointed out the direction and focus of the construction of the rule of law society in our country,namely through the development of deliberative democracy to promote the construction of the rule of law society in our country.This paper consists of six parts,the first part is the introduction,the second part is the related theory of deliberative democracy,the third part is the deliberative democracy in the development and status of governing the country by constitution,the fourth part is the existing problems in the development of deliberative democracy under the rule by constitution and the reasons,the fifth part is to further know the deliberative democracy and development countermeasures,the sixth part is the conclusion of the paper.Based on the premise that deliberative democracy is the basis for the realization of the rule of law and the rule of law society in China.The first part is a review and combing of relevant research results at home and abroad.This part also includes the research significance,research method,research innovation and deficiency.The second part expounds the deliberative democracy and the theory of constitution.Comprehensive law is the basic idea of the party governing principle politics in the new period,is a strategic measure for the development of socialism with Chinese characteristics.Further study of deliberative democracy in the role and value of governing the country according to law in an all-round way,to deepen the reform of political system,promoting the construction of socialist democracy,to realize the goals of building a well-off society in an all-round way has important theoretical significance and practical significance.In the third part,the author mainly discuss the constitutional concept,system and behavior of deliberative democracy in the governance of the country.Firstly,by the constitution preface and text,the realization path of governing the country by constitution,the establishment of consultative democracy,the deliberative democracy follows a further explanation of the constitutional text make detail;Followed by the fundamental criterion of deliberative democracy system and the intrinsic value integration analysis,confirmed that this is not only to the citizens' rights to protect human rights enterprise vigorous development,or follow the fundamental principles governing;In the former two aspects,that is on the basis of combing and analysis of the behavior of the implementation of deliberative democracy and constitutional interaction on the three levels of analysis,put forward that the deliberative democracy is the breach of the rule by constitution,drive,and the claim of main channel.The fourth part mainly illustrates the current situation of deliberative democracy in China,and then,under the background of governing the country by constitution,found the existing problems in the development of deliberative democracy,and to explore the existing problems in genetic analysis.The fifth part discusses the development path and decision-making of deliberative democracy under the background of constitution.A thorough understanding of the nature of consultative democracy is a prerequisite for better development of consultative democracy.Therefore,this part firstly is an in-depth analysis of the characteristics of consultative democracy.On this basis,this chapter mainly from adhere to the leadership of the party,improve the citizens to participate in the negotiation of literacy,increasing the citizen participation in the field of negotiation,improve the citizens' social consensus of consultation system and by the elite democracy expanded to ordinary democracy from several aspects,and discusses the deliberative democracy in the context of governing the country by constitution development path.The sixth part of this paper is the summary.Introduction of deliberative democracy in the process of building the rule of law society system is the optimal choice to promote the construction of the rule of law society,not only conducive to the government more scientific judgment,also enhanced the social citizen's political literacy and social citizens' awareness of the constitution.Rule of law in our country,the period of social transition,the development of the deliberative democracy system in the process of new problems and challenges,all these need us in different periods,standing in different height,explore in different environment and improve the practice of deliberative democracy system form.
