The Logic Of The Contract:the Research On Government Purchase Of Public Services

With the development of the market mechanism,government public services purhase,as a means of public service supply,began to enter people's field of vision.Under the vigorous promotion of our government,government public services purhase has developed to a certain scale.Not only has the system itself been developed,it has also provided institutional choices for the public governance of the market society.However,there are still many problems such as formalism,imperfect procedures,the lack of public contract management mechanisms and etc.,which need to be faced and solved in the development process of Chinese government public services purhase.This paper takes the contract as the starting point,takes the public contract management as the research perspective,and uses the government public services purhase as the foothold of the research.Therefore,the basic assumption of this paper is:The public contract is essentially a governance structure of the market society and it is an external manifestation of the public contract relationship in the market economy.And it is in the framework of public contract management that the government purchases public services.Then,according to the guidance of the above framework,this paper will sort out the origin,development processes,achievements,difficulties faced,the root causes of the difficulties and the optional path for the purchase of public services.First of all,this paper,combining the nature of the contract,trys to build the explanatory framework,which is based on the the contract-based public contract management.Then the paper considers the government purchase of public services as the public contract management based on the public contract,and explains how the government should purchase public services and how the public contract should be structured and optimized.Secondly,through historical facts,this paper sorts out the development process of our government's purchase of public services,sums up the characteristics presented in the development process,and analyzes the internal mechanisms that contribute to these changes.Thirdly,the research perspective is turned to the practice of the Chinese government public services purchase.Through a large amount of data and actual cases,this article discusses the achievements and difficulties faced by the Chinese government in the development of the purchase of public services.Focusing on the explanatory framework of public contract management,the causes of the difficulties are analyzed.Finally,based on the logical basis of "reshaping the public contract relationship," this paper proposes an optional path in order to respond to the the emphasis on public interest and enhance the purchase practice from our government.This paper is a tentative study on the government public service purchase.It tries to understand this purchase practice in a more in-depth way with the new perspective of the contract and the unique research perspective of public contract management.However,to some extent,the lack of relevant primary data has weakened the persuasiveness of this paper's argument.The analysis of the theoretical level is far from being able to solve the complicated delimmas of the government public services purchase in reality.This is obviously a topic worthy of further study in the academic community.
