Research On Sound Trademark Registration System In China

Adaptation time development request,trademark in China has officially brought Sound Trademark into the legal category of the protection of Trademark Rights from May 1,2014,legislative approval is relatively late,so it's registration system needs to be perfected.This article first elaborates the basic theory of sound trademarks.The concept,characteristics and types of sound trademarks were analyzed.The research of basic theory can help us better grasp the sound trademark and lay a theoretical foundation for the study of the registration system of sound trademarks in China.Secondly,expounds the current status of our country's sound trademark registration system,and points out the problems still existing in our country's trademark registration system based on the legal regulation and registration review standards of sound trademarks in our country.For example,the written expression of sound signs is not clear and there is no clear sound registration and no clear prohibition of registration of functional sounds.Thirdly,compares research on sound trademark registration systems in countries and region outside of China.It analyzes contrast the international or regional organizations,Continental law system and Anglo American legal system country or region sound trademark registration system.The sound trademark systems of the above countries and regions have their own advantages and disadvantages,it provides suggestions for the improvement of the sound trademark registration system in China.Finally,it puts forward the measures for the improvement of the trademark sound registration system in our country.They are clearly express the written form of the sound mark,clarify the minimum time before the sound mark application is registered,and increase the ban on functional voice registration.In short,not only the mature and perfect registration system of Sound Trademark is the foundation of promoting the development and popularization of Sound Trademark in China,but also is the need of acting on international trend and strengthening of the comprehensive protection of Trademarks in China.
