| Labor inspection is an important means to safeguard the rights and interests of workers and adjust labor relations,It is also a basic system for promoting the economic and social development in all countries.It has an indispensable role in managing society and implementing labor policy.In the context of economic globalization and China ’s economic system deepening reform,labor relations are becoming increasingly complex,the market’s own profitability exacerbated the formation of "strong employers,weak workers" pattern.Some employers ignore the labor laws and regulations,violate the legitimate rights and interests of workers,the contradiction between workers and employers is becoming more and more acute.The grim situation poses a challenge to the ability and level of labor inspection law enforcement,the traditional management model is often helpless in the face of new problems and new situations.How to play the effectiveness of labor inspection,strengthen the capacity building of law enforcement,has become an important issue.This study starts from the labor inspection system in our country,and analyzes the characteristics of the contradiction between workers and employers based on the perspective of economic and social development.Workers’ wages,working hours,holiday rights,labor protection and other requests are increasing,the contradiction between the workers and employers is intensified.As the last guarantee of the legitimate rights and interests of workers,the lack of labor inspection law enforcement ability leads to long processing period,low efficiency and high cost.Labor inspectors are relatively few,but the task is very heavy,and the ability to proactively prevent and respond to risks is poor,labor inspection can only cope.So it is of great significance to enhance the ability of labor inspection both from government and from social perspective.Based on case analysis method,this paper analyzes the present situation and the effectiveness,also the problems of labor inspection in Hongze district.It is believed that the level of team building is backward,the organization position is not correct,the law enforcement means is single,social governance and “Two Networks” management is very weak,and there are obstacles to judicial connection,these are the main reasons causing the inefficient enforcement.If these problems can not be properly resolved,it will affect the government’s ability to deal with social issues,the rights of workers cannot be fully protected.By comparing the practices and means of labor inspection in the United States and Europe,and drawing on the innovative experience of enhancing the law enforcement ability in some areas of our country,the paper puts forward the corresponding countermeasures and suggestions to the labor inspection law enforcement.These include that innovate the concept of labor inspection,improve the work system,promote service-oriented change,strengthen the corporate credit mechanism,and improve urban and rural social management capacity.These measures are based on the requirements of economic and social development,to promote the reform of labor supervision system to develop in depth.It is hoped that the law enforcement activities have some guiding significance. |
