However, the phenomena of violating their rights and interests nowadays are so severe that it becomes an obstacle towards our purpose of building a harmonious society of socialism. Emigrant workers, who took shape during the process of China's reform and opening up and the beginning and improvement of China's socialist market economy, has its own unique characteristics compared with that of traditional working class and labor unions shoulders unavoidable responsibility in protecting emigrant workers'rights and interests, but labor unions presently show some inadaptability in this aspect. By defining the class nature of emigrant workers and analyzing the existing problems encountered by labor unions in the process of protecting emigrant workers'rights and interests, this article tries to study the function that labor unions may perform in protecting emigrant workers'rights and interests and means to find some new thinking and methods in this particular aspect.The essay composes preface and the main body. The preface introduces the reason for choosing this subject, present domestic situation of research in this field, research approaches and creative points of this article, which lay a foundation for analysis of this subject in this essay. The main body is made up of four parts. The first one defines the class nature of emigrant workers under the guidance of basic principles of Marxism class analysis, which is the theoretical basis and focus of this article. The second part explains their group characteristics and the real situation of violation of their rights and interests. The difference between emigrant workers and traditional working class requests that labor unions must pay enough attention to emigrant workers'group characteristics, which is the objective precondition of improving labor unions'policy and suggestions in the process of protecting emigrant works'rights and interests. The actual problems of labor union in protecting emigrant workers'rights and interests are analyzed in the third part.
