The Research On Exemption Excuses Of The Administration Accountability System

In mainland China,administration accountability system began developing since the SARS period.It enhanced the civil servants' responsibility consciousness,effectively prevented the public power being abused.But because of the imperfection of impunity system,it seriously killed the enthusiasm of the civil servants,reduce the efficiency of public power.AS an important part of the administration accountability system,impunity and accountability mechanisms complement each other just like an integral whole.In the impunity system,confirming the exemption excuses is the most important.The defining of exemption excuses are the requirements of power and responsibility consistent,the requirements of integration of administrative restriction mechanism and incentive mechanism,and is the requirements of improving the administrative efficiency and the performance of official.It is significant for making up for the vulnerability of the theory research about administrative accountability system,and improving the system of administrative accountability.It is also has an important role for enactment of administrative accountability law.According to the distinction between main bodies,this paper divided the specific standards of the exemption excuses into two categories.First,the exemption excuses of leadership responsibility include adopting necessary preventive measures,taking reasonable attention in case of emergency as well as the innovation plan did not achieve the desired effect which is conform to the rules.Second,the exemption excuses of administrative law enforcement officials' liability including the circumstance are obviously minor and correcting actively,executing as the demanding of superior authorities,administrative personnel actively fulfill their duties,things do not due to the responsibility of the administrative law enforcement officials and other special circumstances.The establishment of these exemption excuses can not only balance the balance of power and responsibility,but also help to promote civil servants administrative more actively and improve the efficiency of power exercise.
