Research On The System Of Judge’s Accountability In China

Judiciary is related to justice,people’s livelihood and the authority of law.It is the only way to improve the accountability system of judges in China in order to highlight the fairness and justice of the judiciary,and give full play to the due value of the judiciary.Perfecting the judge’s responsibility system is not only the top priority of Chinese judicial system reform,but the key to achieve the goal of judicial justice.Accordingly,perfecting the responsibility system of judges in China is vital.On the problem of the imperfect system of judges’ responsibility in our country,including the different standards of judging wrong cases,the vague constitutive requirements of responsibility of judges,the absence of immunity on judge’s responsibility,and the unclear form of judge’s responsibility.In order to perfect the responsibility system of judges in our country,including making the same standard of misjudged cases,clarifying the composition of the responsibility,supporting the immunity provisions and making it distinct from other forms,here some feasible suggestions put forward.This article mainly follows the thought of the combination of literature,system and comparative study,starting with basic principles of the judge’s responsibility system,in order to bring the general situation of the judge’s responsibility system of typical developed countries such as the United States and Japan into the regulations of judge’s responsibility system of our country according to local conditions,and provide foreign beneficial experience for the improvement of judge’s responsibility system of our country,this paper focuses on the contents of the different standards of misjudged cases,the constitution of judges’ responsibility,the lack of the responsibility immunity,unclear responsibility forms and so on.Combined with the specific situation of the relevant judicial practice in our country,this paper gives some suggestions on improving the responsibility system in our country,protecting the professional rights and interests of judges in our country,also promoting judicial independence,justice and public trust.
