Theory Of Proecedure Regulation Of Traffic Law Enforcement Inspection In Our Country

A good traffic environment is an important guarantee for the economic development of countries and regions,and traffic enforcement is an important mean to ensure the smooth flow of traffic safety and good travel environment.The inspection of law enforcement behavior is one of the important types of law enforcement in the process of traffic law enforcement work.However,there are several serious procedural problems in China's work of traffic law enforcement,which brings greater difficulty to the traffic law enforcement inspection work,but also easily leads to damage the legitimate rights and interests of the relative people,and is criticized by the society.This paper argues that,at present the multiple departments in our country traffic administrative law enforcement inspection,the chaotic set of inspection authority,and the complexs contents of the law inspection cause many problems.For example,the actual inspection behaviors of law enforcement start at random.The power is headstrong and lack of control,effective legal remedies for inspection behavior.The reasons for these are mainly due to the lack of legal thorough rules of law about the administrative inspection procedures and theoretical research for the administrative inspection procedures in our country.There is the relatively heavy entity light procedure thought in aspect of the legislative practice.Law enforcement officers abuse power for personal gains.On the legislative practice,the procedures of law enforcement inspection become a mere formality.Meanwhile,the right-protection awareness of administrative relative person is not high.This paper argues that our country should pass the systematic administrative procedure law to change this situation as soon as possible,which can take the traffic law enforcement inspection procedures into the administrative procedure law for regulation.The management responsibilities of relevant traffic administrative departments should be strictly divided,and the start-up of power of traffic inspection and the exercise of power of inspection should be regulated.The law should stipulate that the administrative inspection work can be supervised in the administrative system,and makes sure the legal relief ways of traffic enforcement inspection.In the meantime,our government should strengthen the training and examination to law enforcement officers.
