Study On The Legal System Of Mining Investment Access Of Zambia

Investment access is an important stage of overseas investment,which is the key to decide whether the foreign investor could entry into a country and carry out business plan.Therefore,in the theory and practice of international investment law,scholars and investors are highly concerned about the issues of investment access.Recent years,because of the intense competition for mineral resources,international investments in mining industry have increased rapidly.However,mining industry has close relationship with the economic security,the mining investment must be limited by a country's mining investment legislation and regulations concerning investment access.Zambia processes rich mineral resources,its national economy mainly depends on the development of mining industry.The government has devoted to updating mining policy,perfecting mining legislation and improving the mining investment environment.Compared with other African countries,Zambia has a good situation for investor and a relative perfect legal system of mining.Although lack of unified and specific mining investment laws,the rules of the investment access relating to investment subjects,investment procedure,investment treatment and investment boundary are dispersed in various law and regulations.The establishment of mining investment access legal system of Zambia is mainly based on three legal documents,including the Investment Act,Development Act and Mines and Mineral Act,which has defined the qualifications of mining investment bodies,the entrance procedure of mining investment,the scope of mining investment and the preferential treatment to foreign investors.In addition,the corporation law,labor law,environmental law and others also have provisions about investment access,such as the organizational form of foreign capital enterprise,the relationships with local employees and the environmental matters in investment.So it's worth of learning the mining investment legal system of Zambia.China and Zambia has kept good economic cooperation,especially in the field of mining investment.According to current situation,there is a good prospect for Chinese investing mining industry of Zambia.But most of scholars are focus on Zambia's investment environment or investment law.There are few people study on the mining investment access.Therefore,it has significant realistic meaning to analyze the rule of investment access in investment law and mining law or other relevant law from micro level,which could help investor further know the investment access legal system of Zambia.In order to give some legal advice to Chinese investor and investment,this article start from the source of investment access system of Zambia,focus on the research on the code about mining investment access and then summarize the regulations concerning capacity of investment subjects,approval procedures for mining investment,the scope of mining industry access and the treatment or investment incentives.
