Study On Australian Mining Investment Review Mechanism

Due to the development of the economy,countries are increasingly depend on mineral resources.And because of the scarcity and non-renewability of mineral resources,relying solely on domestic resources is difficult to meet the needs of their own economic development.Australia is honored as a “country sitting in a mine car” and its openness to foreign investment has been one of the preferred countries for mining investment in various countries.But Australia's open foreign investment attitude does not mean its absolute tolerance for foreign investors.Blind investment without fully understanding the Australian government's review mechanism for mining investment is bound to cause a stranded investment project.Therefore,for foreign mining investors,in order to understand Australia's mining investment opportunities accurately,it is important to know Australia's mining investment review mechanism.With the signing of the China-Australia Free Trade Agreement in 2015 and the advocacy of China's “Belt and Road” initiative and Australia's “Northern Development” strategy,Chinese mining investors have ushered in a new round of development opportunities for Australian mining investment.Chinese mining investors should fully understand China's current investment situation in Australia,familiar with Australia's mining investment review mechanism,and grasp new opportunities on the basis of learning from failures and successful experiences.This article is divided into five parts.The first part mainly introduces Australia's review mechanism for foreign mining investors.It considers whether foreign investors can access the national interest review mechanism of the Australian mining market and protect the domestic ecological environment.The review mechanism and the review of the indigenous peoples' rights review mechanism of indigenous peoples briefly explain the characteristics of the three review mechanisms;the second to fourth parts of this paper focus on the national interest review mechanism,based on the first part.Environmental protection review mechanism and Aboriginal land rights review mechanism,and explain in each part the review that foreign mining investors will encounter under the three mechanisms and the factors considered by the Australian government under each review mechanism;the fifth part first analyzes the dilemma faced by China in the three system reviews when investing in mining in Australia,and then puts forward some shallow countermeasures under the three review mechanisms inAustralia.
