Research On Legal Guarantee Of Athlete’s Labor Right In China

With the development of market economy,China’s rule of law construction is also accelerating.However,athletes-participants of athletic sports,promoters,their survival and development of labor rights,but in the law is difficult to get the fundamental protection.This not only led to many violations of the athletes labor rights of the case occurred,but also hindered the vigorous development of China’s competitive sports.The contradiction between the development of sports undertakings and the lag of the rule of law construction has caused many athletes’ labor remuneration to be not effectively guaranteed,the social insurance is not perfect,the dispute resolution mechanism is difficult to be smooth and the effective rights and interests of the athletes can not be effectively repaid.Athletes as a class of special workers,has its unique characteristics of the right to work.Which makes the existing "labor law" in many provisions on the provisions of the athletes can not meet the protection of the right to labor.Therefore,this requires us from the reality,combined with the characteristics of athletes,put forward specific and effective solutions and measures.Specifically,mainly from the following four parts: The first part mainly introduces the concept of labor right and the characteristics of athlete’s labor right;The second part mainly analyzes the causes of the infringement of the athletes’ labor right in practice;The third part analyzes the advanced practices of the protection of labor rights of extracurricular athletes,and what is worthy of our reference and learning;The fourth part is mainly from the legislation,law enforcement and judicial relief and so on,put forward some of the feasibility of the protection of the labor rights of athletes recommendations.I hope that through the study of this issue,can arouse the community on the athletes of this special group of labor rights protection attention,and can explore a practical protection of the road,with a view to better regulation of the sports industry,and athletes labor The protection of the right is helpful.
