Labor Rights’ Protection In The America BIT Model Of 2012 And Our Nation’s Countermeasures

With the development of economic,China signed more and more bilateral investment treaties(hereinafter BIT)with other countries.In order to promote the economic development of China and the USA,China and the USA resumed the negotiation of bilateral investment treaty.In the procession of negotiation,the protection of labor rights gained attention.Protecting labor rights has been an important legislature content.With the acceleration of globalization and the development of human rights conception,countries like the USA start to put labor rights’protection into investment activities.Therefore,studying the protection of labor rights in the area of investment activities has practical meanings.The article starts on the contents of the USA Bilateral Investment Treaty Model of 2012,then analyzes imperfection of our nation’s labor legislation and status quo of labor rights’protection of investment treaties between our nation and other countries,in the end,the article makes suggestions on our nation’s labor legislation.The first part of the main article makes a brief introduction of BIT,elaborates the history development of BIT.Then the article makes an elaboration on the change of labor rights’ protection in the USA BIT Model of the year 2012.2012 BIT Model was amended and bettered on the basis of 2004 BIT Model.Labor rights of 2012 BIT Model has strong tires with human rights,labor rights is an extension of human rights in labor area,core labor rights are reflection of fundamental rights.The second part of the article is focused on four core labor rights and acceptable working conditions of 2012 BIT Model,combined introducing core labor rights conventions of International Labor Organization(hereinafter ILO).The third part of the article is about scenarios of our recent labor law and labor rights’ protection of investment treaties between our nation and other countries.The article elaborates imperfection of labor legislation by comparing differences between our nation’s labor legislation and ILO conventions.The last part of the article is about ways to better labor rights in investment treaties signed by our nation and other countries.Through bettering labor legislation concerned with core labor rights and showing our stance on signature of BITs with other countries,we can protect the interests of our investors abroad.The international community attaches more and more importance to adding labor rights’protection into investment activities,meanwhile,our nation has a more and more strong economic ties with the international community.Thus adding labor rights’ protection into investment is good for our economic development.Our nation is a country with a large population of labor force.Perfecting labor law has great importance to employers’ rights.It also embodies the concept of people-oriented.
