Research On The Copyright Protection Of Network We Media Under The Condition Of Shared Economy

The rapid development of social economy,day by day,increases people’s demand for resources.The network has not also provided convenience for people to acquire and utilize knowledge,but also to a large extent promotes the innovation of knowledge.The benefits brought by copyright are the source of innovation,but the too much protection of the interests of the copyright owners is not conducive to the prosperity and development of the socialist culture with Chinese characteristics.The emergence of the network we media platform provides a new way for the release,dissemination and sharing of media works.But the question lies in how to maximize the protection of the rights and interests of network we media copyright owners under the shared economic conditions on the basis of promoting cultural prosperity and innovation.The first chapter of this paper mainly explains the internal link between the shared economy and the copyright of the network we media works,that is say,both has reflected the value orientation of benefit balance.The second chapter compares the copyright of the network we media works with the traditional copyright,and clarifies that although there are differences between exclusiveness and the rationality,the identification of the network we media copyright should still be consistent with the requirements of duplicability and originality in copyright laws.The third chapter,through the typological analysis of infringement behaviors of the network we media copyright,has found that the infringement of the network we media works copyright is easy to be neglected,for there exist many significant characters,for example,the infringement cost is generally low,the influence of the infringement is extensive,collection of the evidence is difficult and so on.The fourth chapter analyzes and lists the relevant laws and regulations of our country as well as the service agreement of the network we media platform,and finds out that copyright protection of the existing laws and regulations of our country for the we media works is still regulated by information network transmission.Therefore,there is still a series of issues:the identification standard for reasonable utilitarian is rigid,the scope of statutory permitted utilitarian is narrow,and the copyright infringement compensation standards are too obsolete to apply to the network we media copyright infringement and so on.Finally,by combining with social practice,it put forwards specific protection measures that can meet the development characteristics of network we media and adapt to social and cultural innovation needs.That is,to exert a series of measures in the copyright laws to achieve soundness and perfection of copyright protection of network we media the in shared economic conditions:add implied license system,update the standard of the rational utilitarian,expand the scope of the statutory license,and adjust the copyright law infringement standards.Only in this way can we further promote the prosperity and development of our country’s socialist culture with Chinese characteristics.
