The decision of the Third Plenary Session of the Eighth Central Committee of the Communist Party of China shall allow the collective construction land to be marketed in the form of transfer,lease and share,so that the collective land and state-owned land shall be the same as the same price,provided that the government is in line with the government’s planning for urban and rural areas,But also in line with the use of the relevant control,built a unified construction land market.This means that at this national level on the collective management of construction land into the city’s attitude by the negative to encourage.In reality,there are many areas to carry out self-employed collective construction land into the market.In order to implement the collective management of land for construction reform,in February 2015 the State Council has approved 33 areas as a pilot for the "three places" reform,which is the middle of the collective management of land use reform into the pilot.Allow the market has become a consensus.However,the state issued a policy to allow the market,but the circulation of income is only a relatively empty statement:taking into account the state,collective and farmers income distribution mechanism,in essence,did not rise to the national level of the legal mechanism.The pilot has made progress in the market,Nanhai District,Zezhou County,Deqing County,Meitan County has become a model,but the income distribution is still facing many difficulties,has become the focus of social disputes.Find the difficulties encountered in the process of entering the market,to explore a viable solution to the path is the significance of the pilot.This paper analyzes the existing problems on the basis of analyzing the arrangement and current situation of income distribution in Nanhai District,Zezhou County,Deqing County and Meitan County,and finally puts forward relevant countermeasures and suggestions.This study aims to provide feasible measures for the distribution of income in China,Using literature analysis methods,standardized research methods,comparative analysis methods,case study methods,Based on the theory of ownership,the theory of taxation right and the theory of villager autonomy,the author points out the legal status and the way of participation of the main body of income distribution in income distribution.Through the collective management of China’s land for construction from the ban to encourage the legislative situation and policy analysis,The analysis of the present situation of the income distribution of the typical pilot areas,Point out the existence of the pilot problem,To demonstrate the objective reality needs of the proposed countermeasures,On the basis of the above research,this paper puts forward the countermeasures to solve the problem of income distribution,In general,including the improvement of property rights system,the government to participate in the law to follow,improve the internal operation of the collective,improve the four aspects of judicial relief.It is concluded that the coordination of income distribution is not only a legal issue,but also related to economics,sociology,political science,the need for joint efforts of the community,continue to explore.
