The innovation of rural collective construction land accessing the market was proposed in the Third Plenary Session of the 18 th CPC Central Committee,so as to make the goal of entering the market equally with state-owned land come true.The "land management law" is brought into force newly and provide a distinct legal support for the market.The reform of entering the market will inevitably lead to the growth of the value of agricultural land,and how to reasonably distribute the income among different subjects has become the focus of the interest parties.Judging from the situation of pilot projects in various places,there are still many deficiencies in income distribution: as for the subjects of income distribution,there is no unified regulation at the national level on which subjects can exercise the right of income distribution,and the practice of different regions is also inconsistent,which needs to be further determined;and as for the objects of income distribution,the disputes mainly focus on which income can be distributed and which standard should be used;when it comes to the income distribution procedure,there are deficiencies in the decision-making system and supervision mechanism;in addition,China’s income distribution dispute resolution mechanism is not perfect,resulting in the contradictions arising from the process of income distribution has not been well resolved.This paper,refer to the existing market entry system and the practical experience of pilot areas,analyzes the outstanding problems of income distribution and puts forward some countermeasures,with that the methods of literature research and comparative research are adopted.The article is composed of six parts:The first part is the introduction.This part mainly presents the research backdrop of this paper,sorts the status in the domestic and overseas,and illustrates the methods,innovation and shortcomings of this paper.The second part is the relevant legal basis.This part mainly defines the relevant concepts,and systematically analyzes and expounds the theoretical basis and distribution principles of each subject’s participation in distribution.The third part is the income distribution system and practice.This part aims to deeply analyze the current situation of income distribution system of China’s collective operating construction land entering the market,and summarize the practice of income distribution.The fourth part is researching the obvious shortage of income distribution and its solution.This part is the primary coverage of this paper,which purposes to refine the shortage existing in the distribution of out of market income based on the analysis and summary of the current situation,such as the confusion of the distribution subject,the disunity of the distribution object,the imperfection of the distribution procedure,and the imperfection of the distribution dispute resolution mechanism.The fifth part is the improvement of income distribution system.This part is another focus of this paper.It aims to put forward some suggestions,such as clarifying the subject of income distribution,unifying the object of income distribution,improving the procedure of income distribution and perfecting the dispute resolution mechanism of income distribution.The sixth part is the conclusion.This paper explains and discusses the legal basis and system practice of income distribution of collective construction land entering the market,which shows that the income distribution of collective construction land is in the stage,only on the basis of following the principle of entering the market and clarifying the relationship between various income subjects,and only in this way can we build a scientific and reasonable market entry system design,so as to promote the coordinated development of urban and rural economy. |
