The Present Situation And Perfection Of Community Correction In China

Community correction system has drawn much attention as a new way of penalty execution,is because of community correction and other traditional ways has a larger difference,can effectively make up for the inadequacy of imprisonment,and is in line with the current social serving penalty development trend.Community correction system itself because of the social value and the judicial value can provide broad space for development for the system and the application of space.In this paper,it is in the system as the main research object,and select the jilin province as an example,a simple description of the system in jilin province for the status quo,problems of the system is analyzed and improved measures are put forward.To ask questions,analyzing problems,the research train of thought to solve the problem,the full text is divided into four parts.The first part of the basic theory part.In this part,first of all to interpret relevant concepts.Concept of community correction should reflect the characteristic of the system.Secondly,this paper briefly introduces the community correction system value and theoretical basis.Community correction system theoretical basis including humanitarian thoughts,tolerance and the socialization concept,etc.Finally,from the Angle of comparison of community correction system is presented in more developed countries,further understanding of the current international community correction system development trend,and some enlightenment to our country.The second part mainly introduces the present situation of the community correction system in our country.This part to our country current involves first generalizes the legislation of community correction system,the main source of law is the \ "criminal law\" and \ "criminal procedural law\".As key research areas,then the choice of jilin province introduced the present situation and problems of community correction for this area.Through to the jilin province the land system of community correction is introduced which can reflect the characteristics of community correction system in China at present.The third part is based on the status quo of the current our country community correction analyzes its existing problems.Community correction is a system of mass base is weak,many social people know little about this system;The second is the system in practice apply rate is low,influence the development of the system,presents the marginalized situation;Three is the community correction system main body is not clear,the judicial administrative organs,public security organs and unclear responsibilities between communities,greatly affect the efficiency of the system of community correction,hinder the further development of the system.Fourth,imperfect management system of community correction.The fourth part puts forward the specific measures to further improve the system of community correction in China.The perfection of related supporting system is the premise,including hearing system and the system of criminal record elimination and so on.To further improve the management and supervision of the community correction system,especially to make clear the incentives of inmates,encourage inmates positive obligations,observe discipline.As a social people to improve understanding of the system to better fulfill their duties of social supervision,as inmates should also have a group consciousness,to return to society better.Finally,to promote community correction of government purchase.As system innovation,the model in China be promoted step by step and achieved good results.
