| With the rapid development of social economy, the highway not only promoted the modernization of transportation, but also led to a country’s urbanization process, so the development of the highway industry countries are very important. As the highway construction, operation, maintenance, conservation and other needs of a large number of capital investment, the world combined with their own economic conditions,respectively, to take a different policy. Some countries this part of the funds all by the state investment, and some countries through the issuance of bonds, tax. bank loans and other channels to raise. Different forms of capital investment will have a different way of management. The former highway for more free passage, and through government loans and other means to raise funds to build the highway country, and more through the collection of tolls in the form of funds to repay the loan, our country is this one.Therefore, China’s expressway in addition to Hu-Jia expressway, the majority of the implementation of tariff policy.Although the management of whether the charges and other countries around the world are different, but for the standardization of highway management, management of a series of countries have developed the corresponding laws and regulations. Compared with the developed countries, China’s highway construction started late, there are many problems in the management. Such as highway overdue charges, over-standard fees and other phenomena in the country generally and long-term existence. The existence of these problems not only seriously restricts the economic benefits of China’s highway industry to play, but also increased the burden on residents of the passage. In order to further standardize the highway toll management system in China, to protect the legitimate rights and interests of residents and promote the healthy development of expressway, this paper studies the legal problems of highway freeway management in our country. The article is divided into three parts. On the basis of understanding the reality of expressway charging management in our country and the experience of advanced management at home and abroad, the article first analyzes the legal basis of the current highway toll management, and from the angle of administrative law. The legal nature of highway tolls is analyzed. The second part lists the existing problems in the management of expressway in China, and analyzes the dilemma of canceling the highway toll in China in the short term. Finally, according to the relevant theoretical achievements of the academic community,this paper puts forward the corresponding countermeasures for the second part of the induction, and realizes the development trend and implementation plan of the future cancellation of expressway charges. And strive for the short term to achieve the legal system of highway tariffs offer advice and suggestions for the future to cancel the expressway charges to provide ideas, so as soon as possible to achieve highway public welfare. |
