Chinese Rural Left-behind Children Guardianship Research

Chinese urbanization process is deepening.As a result,“the tide of migrant workers ”had emerged and expanded.At the same time,“left-behind children” has become a serious social problem.After China joined the convention on the rights of children,Chinese government gradually attach a lot importance to the protection of minor’s rights and has basically formed a minor guardianship system.However,with the development of the society,new social problems appear constantly,and Chinese current minor guardianship system cannot solve the new social problem like left-behind children’s guardianship deletion,showing a certain hysteresis.With “the tide of migrant workers” growing,left-behind children’s guardianship deletion and their impairment of basic rights are increasingly serious.This thesis focuses on current situation of left-behind children’s guardianship deletion and analyzes the shortage of Chinese minor guardianship system so that propose to build the left-behind children guardianship system to make the left-behind children get effective monitory and protect their basic rights.First of all,the basic theory of left-behind children is briefly introduced by defining the concept of left-behind children and the guardianship of left-behind children.The reason of left-behind children appearance and left-behind children’s right which endowed by law were also introduced.These basic theory is introduced for finding the reason of left-behind children’s guardianship deletion.Secondly,the thesis introduced the law of left-behind children’s guardianship deletion and the current guardianship of Chinese rural left-behind.As a result,we can find that Chinese rural left-behind children’s guardianship has limitations.Thirdly,this article on three aspects to analyses the plight of rural left-behind children guardianship.On the part of nation,national system defects and lacking of national public power to cause the plight.On the part of society,school lack of special education and community inadequate supervision lead to the plight.On the part of family,both of the neglect of parents and guardian,irrationality of family guardianship structure to bring about the plight.Fourthly,the improvement of the rural left-behind guardianship system.On the basis of other country guardianship experience of supervision and in combination with the plight of rural left-behind children guardianship,this article propose to complete the rural left-behind children guardianship from state,society and family aspects.
