Research On Legislation Of Soil Pollution Prevention And Treatment In Hunan

Hunan,as an agricultural province,the soil pollution has seriously influenced quality of agricultural products,human environment and public health.In recent years,the ongoing outbreak of soil pollution caused some certain extent social panic.Although a series of actions have been taken,it still remains many deficiencies.Due to land resource loss,which is caused by soil pollution,cannot be well managed under current laws and regulations,of the local soil pollution leigislation in Hunan Province is imperative.Soil pollution has also been concerned by all counties in the world.From the investigation to the soil pollution legislation of all countries in the world,it shows that the experiences of United States,Germany and Japan are successful to soil pollution.Hunan should learning from their experiences.With the introduction of "Soil Pollution Prevention and Control Action",the local legislative process of soil pollution prevention and treatment in China has been promoted rapidly,especially in Hubei,Guangdong,and Fujian.The previous introductions of soil laws and regulations in these provinces have provided reference templates Hunan legislation.In the legislation of the soil pollution prevention and treatment,Hunan needs to ensure the legislative principles,including the principle of "Protection priority,prevention first,comprehensive treatment",principle of risk control,principle of public participation,principle of polluter responsibility,and principle of benefits.Meanwhile,Hunan should lay emphasis on the key field in the legislation,reinforce the prevention of heavy metal pollution,establish the finance security system,encourage and support the technology research and development,and consummate information publication and public participation.In adittion,Hunan should establish legal system of soil pollution prevention,soil pollution treatment and soil pollution supervision.
