Reflections On Several Issues Of Anti-Domestic Violence Law

Domestic violence as a hot topic of concern,its harm is self-evident,not only is the violation of human rights,will also affect the family harmony,social stability.Domestic violence is present in almost every country in the world,and many countries use specialized domestic violence laws to prevent and suppress domestic violence.Before the anti-family violence law enacted,our country is in a passive state in the prevention and control of domestic violence legislation,and there is no specific law on domestic violence.The provisions on domestic violence are scattered in the laws such as Marriage Law and some local laws and regulations.There are only some advocacy provisions.There is no clear control measures,lack of operationality and practicability,and little effect on the prevention and control of domestic violence.The introduction of the Anti-Domestic Violence Law of the People’s Republic of China has changed the status quo and provided a more complete and practicable legal basis for the fundamental prevention and suppression of domestic violence.This article takes the introduction of the Anti-Domestic Violence Law of the People’s Republic of China as the breakthrough point,and has carried on the serious research and analysis to the Anti-Domestic Violence Law of the People’ s Republic of China.The author thinks that although the law clarifies the concept of domestic violence,but the definition is not accurate,the author from the definition,behavior type,characteristics of the three aspects of the analysis of the definition of domestic violence to put forward their own point of view.After the analysis of the applicable subject of the law,it was found that the law did not indicate the scope of the applicable subject,and the author listed the scope of the two categories of persons who lived together outside the family members and family members.The third chapter and the fourth chapter introduce the domestic violence prevention and control measures,the author of the law of domestic violence prevention and control measures and its practical application in the possible analysis of the situation,the objective evaluation of its achievements and deficiencies,to improve the views.
