Study On The Present Situation And Countermeasures Of The Rural People's Mediation System In Fujian Province

The people's mediation system is rooted in the harmony of Confucian culture,it not only plays an important role in the process of rule of law in China,but also enjoys a good reputation as the "Oriental flower" in the world.Under the background of the current comprehensive deepening of reform,China's social cotradictions and disputes surge in a large number,at the same time,it also presents complex and diverse trends.It makes the public once again turn to the people's mediation system that the contradiction between the explosive increase of social disputes and the lack of grassroots judicial resources is increasingly sharp.Based on the investigation of Youxi County Xicheng Town,using the questionnaire survey,depth interviews and other research methods,analyzes the operation status and the problems of people's mediation mechanism of Youxi County Xicheng Town,try to put forward suggestions to improve the rural people's mediation mechanism of Fujian Province.This paper is divided into seven parts.The first part introduces the research background,the research significance,the research present situation at home and abroad,explains the research ideas and research methods,points out the three innovation points of this article.The second part introduces the connotation of people's mediation and social governance,reviews the development history of the people's mediation in China,and expounds the theory of public governance and the theory of national governance modernization.The third part introduces the function change and the contemporary significance of the rural people's mediation mechanism.The function change is divided into three aspects:the function of dispute resolution,the supplementary function of judicature and the function of social integration.The contemporary significance is summarized as four points:solving the rural social contradictions,promoting the development of rural economy,creating a good fashion in rural areas,strengthening the legal consciousness of rural areas.The fourth part,Youxi County Xicheng Town as the research object,using the questionnaire survey method,interview method and case analysis method,the author introduces the running status of the people's mediation mechanism of Youxi County Xicheng Town,points out the problems existing in the aspects of personnel,funding,publicity,mechanism,and analyses the reasons from the perspective of macro social structure,rural legal environment,rural people's mediation mode.The fifth part introduces the United States,France and other developed countries ADR mechanism,as well as Beijing professional people's mediation mechanism,Zhejiang Zhuji City Fengqiao town standardized people's mediation mechanism,to provide experience for the perfection of our country's rural mediation mechanism.The sixth part puts forward some suggestions to improve the rural people's mediation mechanism in Fujian Province.Firstly,to strengthen the material security;secondly,to implement the performance evaluation;thirdly,optimization of human resources;fourthly,to develop the industrial mediation;fifthly,to explore the government purchase;sixthly,to strengthen the judicial confirmation.In the seventh part,the present study is summarized.
