Legal Issues Of China-Kazakhstan Energy Cooperation

The vision and action file "One Belt and One Road" construction has been formulated in Boao Forum for Asia Annual Conference 2015, this strategic vision provides a new and broad platform for the energy cooperation. The question will grow more and more with China and Kazakhstan's energy cooperation more and more extensive and profound. At this point, it is important to the enterprise that how to use legal ways to protect own interests and avoid conflicts loss. However, relevant laws and regulations are not good enough to promote the energy cooperation. Therefore, it is necessary to reform the legal system of bilateral energy cooperation between the two countries.In this paper, I analysis the legal issues in energy cooperation from the angle of energy cooperation of China-Kazakhstan. At first, this paper studies the safeguard of international law in bilateral energy cooperation, as well as the bilateral agreement signed by both parties, and deeply analyses the problems of both side in energy cooperation. This paper highlights the legal questions of China and Kazakhstan's energy cooperation. Finally, it points out that we can solve the legal problems of energy cooperation from the aspects of improving the regional agreement, the bilateral cooperation agreement of China-Kazakhstan, China's domestic energy law and the dispute settlement mechanism of the energy cooperation.This paper puts forward some legal issues of bilateral energy cooperation from a comprehensive perspective and presents a very practical advice. The difficulties of this research is that it involves a wide range of legal document, however, the relevant domestic professional laws is very little, which is a big question to this study.
