Analysis Of The Legal Issues Of International Cooperation In China’s Foreign Energy Investment

With the rapid development of China’s economy,China’s dependence on foreign energy is also increasing.Strengthening China’s foreign energy cooperation is the only way to ensure China’s sustained and stable economic growth.Based on the study of the current situation of China’s foreign energy cooperation,this paper analyzes the legal problems existing in the international cooperation of foreign energy investment,and puts forward a new scheme for the establishment of the legal mechanism of China’s international cooperation of energy investment.The first chapter mainly defines the concept of energy and energy cooperation,and analyzes the principles and practices of China’s international energy cooperation with foreign countries,which establishes the theoretical and practical basis for China’s international cooperation in energy investment.The second chapter mainly analyzes the problems existing in the international cooperation of China’s foreign energy investment.First of all,through the research on the current situation of China’s energy cooperation at the global or regional level,we can find out the shortcomings of China’s energy investment cooperation mechanism at the international level;Secondly,through the research on the bilateral investment treaties and tax treaties signed by China in China’s foreign energy investment cooperation,we can find out the problems at the bilateral level;Thirdly,through China’s foreign energy investment based on the analysis of the legal obstacles of international cooperation in foreign investment in host countries,this paper finds out the shortcomings of China’s internal legal system for foreign energy investment in China.Finally,through the analysis of the application of ICSID mechanism,MIGA mechanism and the energy charter dispute settlement mechanism in China,it finds out the problems of the dispute settlement mechanism in international cooperation in foreign energy investment in China.The third chapter is mainly to put forward countermeasures for the problems existing in the international cooperation of China’s foreign energy investment,and put forward suggestions for the cooperation mechanism between China and existing international organizations,as well as the improvement of bilateral and domestic legal systems.One belt,one road,China should take full advantage of the existing dispute settlement mechanism to build a dispute settlement mechanism for energy investment led by China.
