Research On Delemma Of City Comprehensive Law Enforcement From The Perspective Of Legal Culture

By the end of 2015,the CPC and the Department of the State have offered their guiding opinions that there is serious fault in ruling mechanism,ambiguity in obligations,inadequacy in law,simplicity in management,ignorance in public service and violation in law enforcement.Actually,the jurisprudential circles and the community of management world have done lots of research into the city management and its dilemma,which are confined only to methods of Constitution,Administrative Penalties Law or Science of Management to make an explanatory,descriptive or comparative description,failing to probe into problems from the perspective of legal science(LS for short).The science of legal culture covers a wide area of subjects such legal experience,legal cognition,legal consciousness,legal concepts,legal conventions and legal ideology,based on the theory of which,the thesis makes a thorough analysis on phenomena of conflicts involved in China’s City Comprehensive Law Enforcement,thus disclosing the nature of conflicts,namely,high frequency as spatial and temporal factors are concerned,participation of groups and severe confrontations.Therefore,the thesis owes the dilemma of City Comprehensive Law enforcement to the short of legal basis,no justice of legal science,too many officially assigned tasks and inadequate administrative power prestige.Thus,the thesis bases itself on legal cultural perspective and probes into the ideology from the aspects of the whole society,law enforcement department and the administrative subject and the administrative object,confirming that the dilemma is related to ignorance of nurturing China’s traditional culture consciousness and socialist culture of China’ style by the whole society,law enforcement departments and the administrative subject and the administrative object,and involved also in ignorance of China’s traditional culture consciousness and socialist cultureof China’ style due to the distorted consciousness in the need to make a living,bear hatred against the rich and the most vulnerable group psychology.Further theoretical explanation has been made to obtain the theoretical law basis to extricate the dilemma,holding the view that the building of legal culture for City Comprehensive Law Enforcement Management with its historical sediment is the precondition,the legal basis of order maintaining functions and platform of practicing the law.Research shows that in the aspect of passing new law of legal culture characteristics for city law enforcement department,of building atmosphere of legal culture for the whole society,raising the level for the subject,emphasis has been laid on the necessity practicality and time for concepts of legal culture,showing the significance of the legal culture theory and practice for realization to extricate dilemma.So the thesis concludes that China’s honored traditional legal culture coincides with the scientific socialist theory,the spirit of socialist law of China’ style and the socialist core value theory that serves as the major culture consciousness for the whole society,law enforcement department,the administrative subject and the administrative object to realize self awareness,self discipline,self abiding,self adaptation,self awing and honoring of the law and to make man a man,revealing the target for research into extricating city law enforcement dilemma.
