A Study Of The Fuzzy Words And Its E-C Translation In Legal Texts

This is a report based on the translating of Chapter 11 and Chapter 12 of the 2015 Texas Statutes Health and Safety Code issued in the United States of America.The two chapters for the translation program as the author's graduate thesis provide a comprehensive and systematic introduction to the rights and obligations of the Texas Department of State Health Services,including some inevitable legislative elements as its duties to inspect in local health organs,exempt,engage in enforcement,and so on.During the practical translating of the code,the author of the report has come upon many fuzzy words in legal English which are hard enough for the author to decode or decipher the legal sense during the process of translating from legal English into exact legal Chinese equivalent.Fuzziness of language is a phenomenon widely found in human language and legal language is no exception.Therefore,in order to convey the legal connotation of the source text to the largest extent,legal translators should have a deep understanding of fuzziness of legal language and effectively reveal his or her subjectivity during the course of translation.Accordingly,the author of the report mentioned four translation principles at the process of translation according to the characteristic of legal language,the four principles are "accuracy","equivalence","applicability" and "professional-orientedness".Furthermore,the author of the report also classified the fuzzy words that appear in this source text after carefully analyzing and worked out different translation methods based the types of fuzzy words from source text,and concludes the experiences and lessons learned from this translation practice.As a result,the translator would have to fully understand the fuzzy phenomenon of legal language and carefully adopt appropriate translation method in order to faithfully and effectively convey the information of the original text to meet the demands of the target readers.
