Research On The Risk Countermeasure Of The Employer Based On The 2013 Construction Project Contract

The construction project contract is an important basis for the contractor to fulfill the contractual obligations of the contractor and the contractor.It is also an important guarantee for the achievement of the subject matter of the contract.The content of the contract is the core interest of the contractor and the contractor.2013 construction project contract(Referred to as "13 version" model text ")as a construction project to guide the demonstration of the text,which reduces the disputes of construction market contract,balancing the interests of the contracting parties and achieving a predetermined target each construction.And the contractor as the main terms of the contract of the draft,it is of great significance that how to predict the risk and avoid the risk in compliance with laws and regulations.Therefore,this article focuses on analyzing risk based on the demonstrative text on page 13 of the developer,detailed analysis and by integrating theory with practice,goal oriented,in a systematic and focusing on the combination of the three principles of risk identification,with expert questionnaire survey method and principal component analysis to validate the developer of the identified risks,judging the identified risk that has a significant effect on the developer interest and in turn prompts the developer on the risk countermeasure research,in order to provide the developer in the engineering practice of risk management reference.This paper first studies the "13 version" model text "and compares the differences between the 13 and the 99 version "model text",and focuses on the eight new changes and their shortcomings in the "13 version" model text ".And then to 13 version of the "model text" of the general terms of the contract as the main content,on the basis of the integrating theory with practice,oriented goal and a systematic and focusing on the combination of three major principles and the risk characteristics of the contractor,the paper identifies the risk of the sender and forms the contractor risk list.Second,through the analysis express or implied risk in terms of the contract of the demonstrative text on "13 version" model text ",and combined with the division of risk categories in the engineering practice,the client risk is divided into the timelimit for a project,quality,cost and the other four categories and through expert questionnaire survey method and principal component analysis is used to identify the risk content verification,expression and principal component analysis risk and risk comprehensive evaluation function of expression,and then combine the four common risk response of risk management to deal with the risk of the above four categories of risk.Finally,this article on the basis of the above four types of risk coping strategies,and further research on the risk of the contractor should be combined with the specific engineering case,comprehensive study of the participants in the construction project,improve the 13 version of the "model text" Suggest.
