The Dilemma And Solution Of Environmental Law Enforcement In Gansu Province

The construction of ecological civilization is a millennial plan for the sustainable development of the Chinese nation.The reports of the 19 th National Congress of the Communist Party of China clearly pointed out that the modernization we want to build is the modernization of the harmonious co-existence of human and nature,and we need to provide more high quality ecological products to meet the growing needs of people's beautiful environment.In recent years,the country has attached great importance to environmental protection work,continuously improving environmental law enforcement,ecological environmental protection and environmental pollution prevention and control results are remarkable.However,due to the large difference of regional resources and environment and the unbalanced development of economy and society in China,there are still severe environmental problems in some areas.Gansu Province,which belongs to the underdeveloped areas in the northwest,not only has the demand for rapid economic development,but also faces the severe situation of protecting the fragile ecological environment.How to further strengthen environmental law enforcement,break the dilemma of environmental law enforcement,protect the ecological environment barrier of Gansu,and promote the construction of beautiful Gansu,is an important topic worthy of study.Starting from the ecological environment situation in Gansu province,this paper analyzes the existing problems of environmental pollution and ecological destruction,and based on this,discusses the current situation of environmental law enforcement in Gansu province,including the construction of environmental legal system and the effectiveness of environmental law enforcement.At present,the dilemma faced by environmental law enforcement in Gansu province mainly lies in the unclear division of responsibilities and responsibilities of environmental protection departments,the insufficient independence of environmental law enforcement agencies as a whole,the unreasonable allocation of internal resources of environmental law enforcement agencies,the construction of environmental law enforcement team unable to match the situation andimportant task faced by law enforcement,the single environmental law enforcement measures and insufficient enforcement,and the insufficient role of public participation and supervision.These dilemmas objectively restrict the in-depth and effective development of environmental law enforcement.Shanghai,Guangdong and Xinjiang autonomous region have made scientific and beneficial exploration in carrying out environmental law enforcement according to their own actual situation,and accumulated a lot of practical experience.By analyzing its achievements and experience in the field of environmental law enforcement,we can provide beneficial inspiration for solving the dilemma of environmental law enforcement in Gansu province.To solve the dilemma of environmental law enforcement in Gansu province,we need to suit the remedy to the case,take Xi Jinping's thought of ecological civilization as a guide,make scientific planning,and make steady progress step by step.Specifically,the organizational construction of environmental supervision departments should be strengthened by taking the opportunity of the vertical reform below the provincial level,the internal resources of environmental law enforcement agencies should be rationally allocated,the construction of environmental law enforcement team should be strengthened,rigid law enforcement measures and flexible law enforcement measures should be taken simultaneously,public participation in environmental law enforcement should be ensured and promoted,and social supervision on environmental law enforcement should be strengthened.Through the above analysis and demonstration,this paper hopes that we can effectively break the plight of environmental law enforcement in Gansu province,and provide reference for the smooth development of environmental law enforcement in Gansu province.
