Research On Joint Prevention And Control System Of Atmospheric Pollution In China

In recent years,the process of industrialization in our country and the process of regional economic integration continue to deepen,the characteristics of atmospheric pollution have also changed along with it,from the locality,single type of pollution into regional and compound pollution.In the past,air pollution control was based on administrative units,which is already unable to solve the current atmospheric pollution problem effectively.Therefore,the regional joint control of air pollution prevention and control system emerged as the times require.The research is based on the Theory of Government Environmental responsibility,the Theory of Object-related,the theory of adjacent environmental relations and The value Theory of Law.This paper uses literature research method,comparative research method and empirical research method.Discussed the necessity of establishing air pollution control system.Discussed the basic principles that should be adhered to in constructing the air pollution control system.Hope to improve the theoretical research of China’s atmospheric pollution prevention and control system,and provide guidance for the improvement of China’s joint prevention and control system.In the theoretical study of the air pollution control system,the paper has defined the concept of the joint control system and the necessity for establishment.We believe that perfecting the joint prevention and control system should be consistent with the government’s theory of environmental responsibility,the related theory of objects,the theory of environmental relations and the value theory of law.At the same time,we should adhere to the principle of harmonized development,regional cooperation and territorial management,the principle of unification of total emission reduction and quality improvement and the principle of common but differentiated responsibilities.Through the analysis of the status quo of China’s air pollution control system,consider that this system was initially legally recognized and applied to practice.However,there are still problems such as the basic principle is not clear,the legal provisions are not operative,incomplete cooperation models,subject liability is not clear,lack of benefit compensation systems,and lack of restraint mechanisms.By summing up the overseas experience in the joint control of joint prevention and control of air pollution,we can find out where our country can learn from.Finally,from the seven aspects of improving guiding ideology,refining legal regulations,improving cooperation models,rationally assigning responsibilities,establishing ecological compensation systems,and implementing regional approvals,we have proposed improvements in China’s air pollution control system.
