Research On The Environment Precautionary Principle

Since the 21 st century,environmental problems caused by the rapid development of science and technology have become increasingly apparent,and many problems have irreversible consequences which will affect the future generations.So,the environmental precautionary principle has gotten more and more attention.Nowadays,environmental precautionary principle has been widely recognized by the international community and many countries as a basic principle in the domestic environmental law and international environmental conventions.Our country has gradually realized the importance of environmental precautionary principle,which can be seen from some of our existing law,regulations,including environmental risk prevention principle.However,the application of environmental precautionary principle in the environment of domestic legislation system is not perfect.There are many worthy of research questions.From the environmental risk prevention legislation present situation in the domestic and international principles of our existing legal system,the significance of this thesis and research status of environmental precautionary principle are introduced to clarify the research ideas and summarizes the innovation of this thesis.Then the problems in the environmental protection of our country are analyzed.To solve these problems,the application and advantages of environmental precautionary principle is also analyzed for the international environmental protection.Based on these analyses,it is proposed that environmental precautionary principle should be explicitly incorporated into the existing legislation system.And it also needs to improve the mechanism of some related legislation,such as cleaner production promotion law,environmental information disclosure system,evaluation system and the system of liability insurance.
