The Citizens'right Of Participation In The Ecological Protection And Its Implementation

With the continuous development of human society,the environmental problems such as environmental pollution and ecological damage appear constantly,to enhance citizens' ecological consciousness,they urge to participate in the ecological protection to perform the duties and safeguard their own rights and interests of ecological.But,because the system of our citizen participation in the ecological field is not perfect,and the theory research attached less importance to the establishment of the citizens' right of participation,citizen participation in the ecological protection is faced with great difficulties.Therefore,based on the core problems of citizens' right of participation,I made a systematic study.This paper will be divided into four parts: the first part,mainly introduces the research of background,significance and status at home and abroad to provide a basis for the research of the citizens' right of participation.The second part mainly introduces the theoretical basis of the citizens' right of participation.Based on relevant theories as the legal basis,I put forward this right.In addition,I defined the concept of the ecological right and the citizens' right of participation based on the right subject,object,content and other aspects,and put forward the right of participation' basic function.On this basis,we can find that the realization of the citizens' right of participation in our country have a great significance.The third part mainly introduces the main difficulties and the reasons about the citizens' right of participation in the ecological protection,Caused by a lack of theoretical research in China,the public subject of ecological information and the content is not clear,the restricting power of the government ecological decision-making and the ecological law enforcement is inadequate,our country also faces many difficulties,for example,legislation lag,ecological information disclosure system is not sound,the power of the government is strong and the consciousness of civil rights is weak,etc.The fourth part mainly puts forward relevant countermeasures and suggestions to realize the citizens' right of ecological participation: the first is to perfect the ecological legislation,provide legislative guarantee for citizens to participate in ecological protection better and better;the second is to guarantee the realization of the citizens' right of participation through the implementation of information disclosure system;the third is to use the main means,such as citizen oversight,ecological accountability to improve the government decision-making and ecological law enforcement;the fourth is to enhance the citizens' enthusiasm and initiative to exercise their rights by prizing report system and lawsuit system of ecological.
