Reserch On The Construction Of Legal System Of Enviornmental Liability Insurance In China

With the rapid development of economy and the continuous improvement of living standards,the problem of environmental pollution is increasingly widespread and severe,but also for environmental protection and environmental tort compensation awareness is gradually increased.In China,not only makes the national economy to maintain sustained growth,but also the risk of environmental pollution were dispersed,alleviate the pressure on enterprises,security the compensation of victims and relief,to avoid social contradictions deepen,has become an important thing related to sustainable economic and social development in China the development of environmental liability insurance system suitable for our country in this situation.The environmental liability insurance legal system in our country construction related content level to carry out the research and Analysis on "whether it is necessary to establish" and "how to build" two core issues,the urgency to establish the system of the necessity,feasibility analysis,and how to build on our environmental liability insurance law the system is discussed and thinking.This thesis consists of three parts about introduction,text and conclusion,first of all is the introduction,the text is divided into four chapters,at last the views are summarized.The main contents are as follows:The first chapter starting from environmental damage and environmental tort law theory,mainly introduces the construction ofenvironmental liability insurance system on the basis of the construction of the system,the meaning and connotation of environmental liability insurance are defined and discussed the related concepts,characteristics and the specific function,the necessity and the construction of environmental liability insurance system of description.The second chapter discusses the related contents of liability insurance of our country at present,and the current situation of environmental pollution and the causes were analyzed,discussed the environmental liability insurance in our country at present situation and legislative situation,existing in the development process and related system problems and its reasons.The third chapter introduces the development history and current situation of foreign environmental liability insurance system,discusses the national environmental liability insurance system implementation,summarizes the common features of various systems,and illustrates the construction of environmental liability insurance system in China.The fourth chapter from the insurance model,compensation methods,insurance institutions,legal construction,insurance coverage,insurance premium and so on,put forward the ideas about the legal system construction of China’s environmental liability insurance.
