Research On Improving County Environmental Administrative Law Enforcement Ability

China’s economic development has gone through the economic development stage of "destruction before governance" like other developing countries.It has become a common phenomenon for county-level governments to attach importance to the economy but ignore governance,and enterprises to attach importance to economic benefits but ignore environmental responsibility.In the face of China’s industrial and mining enterprises’ weak awareness of environmental protection and frequent illegal acts,the problem of the government’s insufficient environmental administrative law enforcement capacity is gradually exposed.Therefore,the construction of environmental administrative law enforcement capacity is an urgent issue to be solved under the current "big environmental protection" pattern.In China,the construction of environmental administrative law enforcement capacity at the county level is the most important link in the entire national environmental administrative law enforcement capacity construction system.The environmental protection department at the county level is also the "last mile" to implement the national environmental protection policy and connect the superior departments with the units that produce environmental pollution.Therefore,the research on the construction of county environmental administrative law enforcement capacity has important practical significance and value for the implementation of environmental policy,environmental protection and environmental supervision in China.The case of this article-G County in Shanxi Province is a typical resource-based city.The measures taken by G County in the construction of environmental administrative law enforcement capacity have little effect.A number of high-tech law-enforcement equipment have been purchased,but the lack of talent reserves has led to a low utilization rate of equipment.A certain number of personnel training has been organized,but the training effect is not obvious due to the limited financial capacity of counties and cities and the insufficient level of training teachers.A new law enforcement model has been adopted,but the enthusiasm of law enforcement personnel is not high,and the supervision is not in place,resulting in little improvement in law enforcement efficiency.These difficulties and challenges faced by County G are largely caused by the environment of the county and city.Therefore,these problems are common in other counties and cities in China,especially in economically underdeveloped areas.This paper takes G County of Shanxi Province as an example to study the construction of environmental administrative law enforcement capacity in the county.The study mainly consists of four parts: The first chapter is an overview of environmental administrative law enforcement capacity building.Clarify the concept of environmental administrative law enforcement capacity building.Clear up the relevant theoretical connotation and lay the analytical framework and theoretical foundation for this study.Chapter II G County focuses on the current situation of environmental administrative law enforcement capacity building.Summarize the general situation of its environmental administrative departments and the main methods of environmental administrative law enforcement capacity building,and study its effectiveness.The third chapter focuses on the analysis of the problems and causes of the construction of environmental administrative law enforcement capacity in G County.The research believes that the main problems are as follows:the technical ability of the law enforcement team cannot meet the work needs;The staff’s sense of responsibility is weak and their enthusiasm is not high;The concept and means of law enforcement are lack of originality,and the implementation of law enforcement is not effective;With frequent legal intervention,justice cannot be guaranteed.There are four corresponding reasons: the selection and training system of environmental administrative law enforcement personnel is not perfect;The internal management of the department is loose and the incentive mechanism is not obvious;Lack of scientific and technological innovation and adherence to conventional ideas;"Local protectionism" and "egoism" are rampant.Based on the above research and the author’s front-line work practice,the fourth chapter puts forward countermeasures to improve the construction of county environmental administrative law enforcement capacity.First,strengthen the team construction and ensure the law enforcement ability;The second is to improve the management mode and assessment system;The third is to make up for the weakness of the ability and explore efficient law enforcement;Fourth,improve the supervision mechanism and expand the supervision channels.The author hopes to use the analysis and research of G County to put forward some targeted suggestions on the construction of administrative law enforcement capacity,as a reference for other counties to strengthen environmental law enforcement capacity,and make a modest contribution to the modernization of environmental governance system and governance capacity.
