The Study On The Legal Problems Of City Remediation Of Contaminated Sites In China

In recent years, with the accelerating urbanization and industrial structure adjustment, for the city’s industrial enterprises to move the legacy of contaminated sites has become our country land source reuse of new environmental problems.The urban pollution ground soil,obstacles to the development and utilization of land resources, threats to public health and safety, made an impact on environment, economy and society. Setting up perfect our legal system of pollution ground soil, for the protection of citizen’s environmental rights and interests, and the development and utilization of land resources, promote the harmonious development of urban economy and the improvement of the environment legal system in our country, is of great significance.This paper by combining with practical cases, and the shortcomings of the current legislation, draw lessons from foreign excellent legal system design, from the aspect of legal system of the discussion on the mode of contaminated site remediation ought to be.This article is divided into four chapters, the pollution of city area for the legal issues discussed in this paper.The first chapter, introduce our country reality of contaminated site remediation case, then introduce relevant legislation present situation of our country.The second chapter, analysis the troubles of site remediation of pollution in the city in our country, carries on the analysis from four aspects respectively.The third chaper,introduce foreign system of contaminated sites and enlightenment on repairing field in our courty, in the United States and Japan as the main object of reference, the comparative analysis of the similarities and differences between them and find out the system in our country can use for reference.The fourth chapter, in view of the reference to the present situation of the previous chapters, dilemma, enlightenment, finally conclude the legal countermeasures to design a contaminated sites remediation.
