Identification Of Subjects Of Liability Of Contaminated Sites Treatment In China

With the rapid development of China's economy and the improvement of environmental protection level,combined with the occurrence of soil pollution in recent years,contaminated sites treatment has become the focus of widely concerned in the society.Due to the lack of uniform and standardized legislation,there are considerable difficulties in the identification of the subjects of liability of contaminated sites in China,which directly affect the remediation of polluted land and the redevelopment and utilization of the land resources.It is of great significance to ensure the rational development of land resources and to protect the soil environment and human health and safety.This paper is divided into three parts,the first part of the introduction,which introduce the mainly background.The second part is the text,which is divided into four chapters:The first chapter defines the relevant concepts in the text.The definition of the contaminated sites in the theoretical and current legislation is analyzed,the concrete meaning of the contaminated sites is studied.And the nature and connotation of the liability of this paper is defined.The second chapter introduce the current situation of the legislation,point out the problem,and analyze the reasons from three aspects.In the third chapter,according to the different situations,the basic principles of the identification of the subjects of the liability of the contaminated sites in China are put forward from two aspects.In the fourth chapter,the paper expounds the concrete application of the principles of the identification of the subjects in our country,and analyzes the two kinds of different types of "polluter existence" and "polluter loss" in practice.The third part is conclusion.The identification of the subjects of the liability of the contaminated sites should be based on China's national conditions and realistic background,but it's also important to establish and improve the relevant supporting measures and systems.
