The Research Of The Protection Of Farmers’s Rights And Interests In Rural Land Transfer

Rural land transfer is an important way to adapt to the requirements of productivity. It plays an important role in the allocation of rural land resources and rural economy development. On this background, China has carried out large-scale land transfer in the rural area.However,in the tide of rural land transfer, the problem of farmers’ economic rights and interests protection highlighted increasingly. This paper takes four cases of land transfer in P county as an example, combining the theory of property rights and the theory of land rent from Marxism to analyze the protection problems of farmers ’economic rights in rural land transfer and put forward the corresponding countermeasures.In Marxism property rights theory, clear property right is the precondition of obtaining land rent income,as well as the foundation of land market system. From Marxism land rent theory, differential rent is a better way to protect famers’ economic rights. The protection of farmers ’economic rights in land transfer is essential to the social stability in rural area and good for the development of rural area.Through four case studies and field interviews, found that the protection problem of farmers ’economic rights in P county exist the following problems:farmers’ viewpoint of law is weak,farmers are lack of skills to protect their economic rights, as well as in the weak position in land transfer game;local governments are not neutral, the legal system and supervision mechanism are not effective, transfer procedure is not standard, the degree of marketization is low;Land transfer enterprises ‘legal concept is weak, have no strong sense of social responsibility and is lack of risk assessment.Based on the analyzing of reasons why farmers ‘economic rights are damaged, the paper puts forward the following sugestions:the farmers need to strength their economic rights consciousness, improve the protection skills; the local governments should improve laws and regulations of farmers’ eonomic rights protection, promote the equity of land transfer, correctly orient government’s roles and develop the land transfer market; the land transfer enterprises should improve the consciousness of law and social responsibility, as well as evaluate the risks correctly.
