Administrative Discretion is an important feature of modern administration, as well as the core of modern government administration. The rapid development of social, administrative enforcement discretion also rapidly expanded to use more flexible, but at the same time the consequences arising from its more serious abuse. Road transport law enforcement and citizens as closely related to law enforcement activities, the exercise of discretion exists in every case, the topic of how to make a reasonable moderate benign operation is a practical significance.
