| With the rapid development of the society, the optimization of the economic structure and the continuous extension of the construction land area, lots of farmland are being transferred to construction land of the city. After the farmland is expropriated, the problem involved in the farmland compensation for farmers stands out quickly. Nowadays, most of The compensation standards of land acquisition in China are Unified annual output value ratio method and the area comprehensive land value. These standards are too low, so they increase the social contradictions and lead to extensive Non-agriculturalization of farmland over the years. It’s also a waste of the land resource. The benefits of Land development rights refers to different price of the land after its usage gets changed.Based on the theory of the Land Development Rights, this article studies the problems in land expropriation compensation, as well as the present situation of its distributions. The value of the farmland development rights of all counties in Zhoukou will be estimated by pricing the development rights. To do so, we must act upon the owners’ willingness; meanwhile, pay attention to the compensation standard existed. Therefore, a proper compensation standard of land acquisition will be established, which is also a stragetic combination of the distribution of development rights and economic compensation.In accordance with what are discussed above, the conclusions are as follows: Firstly, the farmers ought to share the earnings of the land development rights with the government. The fact is, however, farmers still have no right to partake in the distribution of land value-added benefits. Even though many local governments used new policies, such as, Comprehensive Price of Requisition Land and etc, so it increased the compensation standard to some extent. Secondly, this article raises a calculation method of pricing the development rights, which is used in this article to estimate the price of both the land development rights and the land compensation in all counties of Zhoukou. Thirdly, on the basis of the land compensation regulations existed, we should decide on a price that’s based on development rights, and takes the farm households’ willingness into account as well. In comparison of the land requisition compensation price that’s based on development rights and the current price, it’s obvious that the former is more in line with the interests of the farmers, which guarantees the farmers’ right to exist and to develop. |
