| This article is based on the background of that population urbanization lags behind of the land urbanization in our country, discussed in the process of rural collective land requisition, function and defects of the existing land expropriation compensation system. And by comparing the land expropriation compensation policy of developed country, further discussing the defects of the existing land expropriation compensation policy in China, draw a conclusion that the land-lost farmers in China’s main problem is the lack of land development rights. Then, this paper introduced the concept of the land development rights. From the perspective of property rights, stating the relationship between the land development rights and land expropriation compensation. Because of the influence of the value orientation, and other government policies, there must be game space between the government and farmers in the land value-added income distribution. So, the land expropriation compensation system which base on land development rights, is the reasonable distribution of the value-added profit of land development rights actually.Secondly, the three compensation paths of land development rights are discussed in this paper, the land development rights monetization, the land development right investment and the land development rights exchange of social security. The land development rights monetization, is giving farmers a one-time monetary compensation through the quantification of land development rights price, operation easily and efficiently, but not suitable for long-term security; By quantitative the land development rights, the land development rights investment arrange investment in the form of a stake in enterprises, issuing equity certificate, farmers share out bonus base on participation of corporate profits. the land development rights exchange of social security is based on the existing land development rights displacement from the actual situation of land-lost farmers’social security level, to improve the social security standard of the farmers, improve the social welfare, etc., this article divided age group with different content of social security. The three kinds of compensation path for different levels of economic development area, its level of security and safeguard way also not the same. Finally, introducing a case study of Lanzhou new district, the shortage of the existing land expropriation compensation system in Lanzhou new district is including the low compensation, the mixed compensation standard and the absence of social security, etc. Because the Lanzhou new district is located in the northwest inland, and the fact that the economic development is low, this paper put forward that the land development rights replacement social security is the rational selection of the land expropriation compensation system in Lanzhou. By combined with the actual situation, analyzed the compensation model of land development rights replacement social security in Lanzhou new district, and put forward the related countermeasure and suggestions. In this way, providing reference for Lanzhou new district expropriation compensation work, safeguarding the rights and interests of land-lost farmers, and promoting the development urbanization in Lanzhou new district smoothly. |
