Industrial injury insurance as an integral part of modern social insurance is the mainform of labor damage relief. Employer’s liability insurance as a kind of commercialinsurance in our country, also play the role of the occupational injuries compensation.Our country is in the rapid economic development and the deepening ofindustrialization, how to coordinate with the two relations in the development ofsociety in our country and give play to the resultant force, is a research focus in thispaper. The study of the relationship and positioning avoid vicious competition dueto the similarity, make its in reducing industrial injury accidents and workerscompensation after the accident. Reviewed the development of industrial injuryinsurance and employer’s liability insurance in our country and the developmentpresent situation, when faced with a large base of our country laborer, and coverage ofindustrial injury insurance limited support capability specific cases, a single mode ofindustrial injury insurance and employer’s liability insurance is hard to make enoughcivil compensation to the injury employees. Society can use a confluence of industrialinjury insurance and employer’s liability insurance to raise the level of labor damagecompensation, give full play to relief function and social management of theinsurance. For further research the situation of complementary and coordinateddevelopment of the industrial injury insurance and employer’s liability insurance, inthis paper, complementary base is analyzed, and from the four production andoperation cases respectively of the insurance coverage, insurance compensation,liability for compensation, technical aspects, it is concluded that at present employer’sliability insurance is the optimal supplement and legal responsibility on the bestchoice for employers. Finally, in view of the actual cases it is found advantages anddisadvantages in both the employer’s liability insurance and industrial injuryinsurance, put forward the coordinated development of countermeasures andsuggestions from the government, commercial insurance companies, the insured threelevels. Research of this paper believes that the current industrial injury insurance andemployer’s liability insurance are coexist mode, we should actively promote thecoordination and complementary development, establish Industrial injury damageprevention and rescue system with the characteristic of our country mainly socializedindustrial injury insurance, supplemented by employer’s liability insurance.
