Food security is related to the physical health and safety of the people, also related to thestability and harmony of the society.Although China’s government attaches great importanceto the food safety problems and takes many effective measures, the current situation of thefood security is still not optimistic. Food security is still an important social problem forChina which needs to be solved urgently at present.The current serious food safety problems in China are connected with the weak foodsafety inspection during the practice. However, ensuring the safety of the people’s dietdepends on well-established food safety inspection system. In order to advance some usefulsuggestions for solving the above problems, this paper attempts to study on China’s foodsafety inspection system systematically from the perspective of administrative law, andinvestigates the food safety inspection system of the developed countries.In order to propose some constructive suggestions and measures on improving China’sfood safety inspection system, this article analyzes China’s food safety inspection system, andalso investigates the food safety inspection system of the U.S. and Japan. This paper isdivided into four parts.The first part defines and analyzes the concepts of administrative inspection and foodsafety inspection. Food safety inspection is embodied in administrative inspection of foodsafety field. Thus, defining the concept of administrative inspection scientifically is thefoundation of understanding the concept of food safety inspection correctly. At the same time,defining the nature of administrative inspection is also beneficial to understand the concept ofadministrative inspection. Therefore, this article attempts to investigate the theoreticaldevelopment of administrative inspection in China, and analyzes some scholars’ views onunderstanding the concept and nature of administrative inspection. Combined with the aboveanalysis and her own thinking, the author proposes her opinion that administrative inspectionis an enforcement activity that the executive authorities of the government supervise theadministrative relative person to obey the law by collecting information or evidence accordingto the statutory authority and procedures. Based on the above analysis, this article discussesand analyzes the concept and classification of food safety inspection.The second part analyzes the problems of China’s food safety inspection system. The current frequent food safety incidents reflect that China’s food safety inspection is not sound.There are mainly four aspects of the problems. First, legal system on food security is notperfect, for example, there is not a unified food safety standard. Second, the procedures offood safety inspection are not standardized, such as initiate randomly, implement simply, anddisclosing administrative information is insufficient. Third, the executive authorities of thegovernment are in chaos, which caused the power cross and inefficiently. There are manyexecutive authorities in an inspecting link. It is very easy to lead to double-inspection or theblind area of the food safety inspection. Fourth, the inspection methods are not scientific.The third part studies on the food safety inspection system of the U.S. and Japan, andsummarizes their successful experience on improving the food safety inspection system. Inthe United States and Japan, there are complete legal system and advanced food safetystandards, and the food safety commission is authoritative and independent. In addition tothese aspects, the U.S. and Japan established a joint inspection mechanism between theexecutive authorities of the government.The fourth part is the concrete suggestions of perfecting China’s food safety inspectionsystem. By learning the successful experience of America and Japan, and combining withactual situation of China, this article puts forward some useful suggestions that thegovernment of China should improve the legal system, perfect the inspection procedures,establish the coordination mechanism, improve the inspection methods and introduce publicparticipation mechanism.
