Study On The Function Changes And Development Tendency Of Shanghai Entry-Exit Inspection And Quarantine Bureau

This paper aims to demonstrate the necessity and urgency of reform, realizing transformation of government functions in the China Inspection and Quarantine system, and based on the study of Shanghai Entry-Exit Inspection and Quarantine Bureau, proposing some thoughts and ideas of how to change Inspection and Quarantine functions under the new situation of reform and development.This paper describes the responsibilities of Shanghai Entry-Exit Inspection and Quarantine Bureau; the development process and functional changes of Shanghai Entry-Exit Inspection and Quarantine Bureau; analyze the progress at each stage for adapting to new situations and inevitable defects due to the historical conditions. In particular, analyze institutional malpractice faced by foreign trade growth. Summarize the status quo, advantages, taken technical trade measures of the Entry and Exit Inspection and Quarantine systems in developed countries, particularly of China’s major trading partners (U.S., EU, Australia and Japan). Through profound understanding of history and horizontal comparison with other countries and regions, obtain inheritance wealth of history and receive international experiences.In the technical inspection and quarantine agencies of law enforcement, laboratory test results are important basis for making the specific administrative act under the current system. This paper compares differences between foreign testing laboratories and china inspection and quarantine laboratories, and focus on analyzing the current shortcomings in functional orientation of our laboratories. Propose a ternary structure should be constructed in China Inspection and Quarantine laboratories:research and authoritative examination centralized in national academy of Inspection and Quarantine System; public service centralized in state key Laboratories of various ports; routine laboratory tests be undertaken by open market, such as accreditation agencies and universities. Government laboratories should retain the function of collecting foreign strategies, analysis and research, accelerating the construction of national standards and testing methodology, collecting national economic security protection techniques, and meanwhile plays a role in the foreign technical trade barriers cracking and our technical barriers construction by rational use of the SPS Agreement.This paper analyzes the challenges facing Shanghai Entry and Exit Inspection and Quarantine Bureau in China (Shanghai) free trade zone(FTA) construction process; analyzes the existing problems in carrying out the inspection and quarantine laws and regulations, and researches the feasibility of policy breakthroughs and innovation in Bureau’s FTA construction. DHL North Asia hub as an example to put forward specific plans:decentralization, simplification of inspection and quarantine processes and reduction of enforcement steps. Moreover, FTA could unified the electronic data platform-in which realize the one-step declaration (inspection, customs) of Shanghai inbound and outbound goods, quarantine, inspection and discharge; promotes e-government construction; develops inspection and quarantine negative list; integrates inspection sites of customs and quarantine system; further facilitate the cargo clearance process so as to promote trade and economy.
