Research On Transfer And Continuation Of Endowment Insurance Of Migrant Workers

As an important part of the social security system in China, migrant workersendowment insurance system has been not established up to now. However, the factwas that the migrant workers were not protected by the social security system inChina in the past, which went against the universal coverage principle of theendowment insurance system in China. In view of a fact that they has been in anerratic flowing state, the central government formulated and enacted policies, whichare that migrant workers can voluntarily attend the new rural endowment insurancewhen they farm in a countryside all year round; Migrant workers must participate inthe basic old-age insurance for urban workers with their employers according torelated laws when they go to any one of the cities and towns among all the provincesand work in the enterprises or factories. That is a blessing for hundreds of millions ofmigrant works, one that the country guarantees their essential life after retirement. Itproves that our country adheres to the concept of people oriented and truly paysattention to improve people’s livelihood. At the same time, it is an inevitablerequirement of perfecting the social security system. The country may force migrantworkers to attend it in order that their old-age life can be weathered. But the questionsare how migrant workers transfer the relation of the endowment insurance, whether ornot they can successfully connect it after they leave the old working area and go towork in a new one, and what kinds of problems they will be faced with in the processof transferring it. Why did a mass of migrant workers choose to exit from the basicpension insurance for urban employees in the years of2008and2009? How does“Interim Measures for inter provincial transfer of enterprise workers basicendowment insurance in the urban” affect migrant workers to transfer theirendowment insurance relation? Is it a gospel or only one policy? What a kind of rolesshould “Interim Measures for the combination of urban and rural endowmentinsurance systems” play about the transfer and connection of migrant workers’endowment insurance?Therefore, this paper, which takes migrant workers as research objects, shows the research on the problem of transfer and continuation of endowment insurance.First of all, a series of concepts are defined and three major theoretical foundations ofcitizenship and rights theory, institutional change theory and the theory ofcompensation principle, which the research depends on, are set out; secondly, theauthor makes a reasoned analysis on the current status and difficulties about transferand continuation of the relationship of migrant workers’ pension insurance, which isbased on the official data, questionnaire data and interview data; And then, possiblereasons are dug on the basis of related three theories; finally, guided by theories,especially the system vicissitude theory above, the author manages to find out thesolutions to the plight of transfer and continuation of migrant workers basic pensioninsurance relationship, namely “there is a law, which can be according to, which mustbe depended on, must be strictly carried out and must be a basis for punishing themfor illegal behavior once some breaks the law,” with moral constraints and individualconsciousness.
